These Terms of Service (the “Terms”) govern your use of the Monster Siomai marketing site at monstersiomai.ph and the Customer Portal at customer.monstersiomai.ph (together, the “Services”), operated by Omnilert Food & Beverages.
1. Agreement to these Terms
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Notice. If you don’t agree, please don’t use the Services.
2. Who we are
The Services are operated by Omnilert Food & Beverages, a Philippine business operating the Monster Siomai brand. References to “we,” “us,” and “our” mean Omnilert Food & Beverages.
3. Eligibility
You must be at least 18 years old to create a Customer Portal account. By creating an account, you confirm that you meet this requirement. One account per person, please.
4. Your account
- You’re responsible for keeping your password confidential. Do not share it.
- You’re responsible for activity on your account. If you suspect unauthorized access, change your password immediately and contact us.
- The information you provide must be accurate. Keep it up to date through the portal’s settings.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used abusively (see “Termination” below).
5. Acceptable use
You agree not to:
- Use the Services for any illegal purpose or in violation of any law.
- Scrape, harvest, or otherwise collect data from the Services through automated means without our written permission.
- Attempt to circumvent rate limits, security controls, or authentication systems.
- Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Services, except where permitted by law.
- Impersonate any person or misrepresent your affiliation with Monster Siomai.
- Interfere with the operation of the Services, including by sending malicious traffic, exploiting vulnerabilities, or attempting denial- of-service attacks.
- Create more than one account, or create accounts on behalf of others without their permission.
6. Loyalty program
The Monster Points loyalty program is offered through the Customer Portal and is governed by additional terms in our Loyalty Program Terms. By participating in the program, you agree to those terms in addition to these.
7. Intellectual property
The Services and their content — including the Monster Siomai name and logo, the “Monster sa Laki, Monster sa Sarap” tagline, illustrations, photography, copy, recipes, and software — are owned by Omnilert Food & Beverages or our licensors, and are protected by Philippine and international intellectual- property law.
You may view and interact with the Services for personal, non-commercial purposes. You may not reproduce, modify, distribute, or commercially exploit any content from the Services without our prior written permission.
If you submit content to us (for example, a contact-form message), you grant us a worldwide, royalty-free license to use that content for the purpose of providing the Services and responding to your inquiry. You retain ownership of your content.
8. Third-party services
The Services rely on third-party providers (notably Odoo for the loyalty program and Resend for transactional email). Their handling of personal data is described in our Privacy Notice. We are not responsible for the practices of any third party we link out to (for example, from our social-media footer links).
9. Termination
You may close your account at any time by contacting us. We may suspend or terminate your access to the Services if:
- You breach these Terms or the Loyalty Program Terms;
- We reasonably believe your account is being used fraudulently or abusively;
- We are required to do so by law.
Upon termination, any unredeemed Monster Points may be forfeited as described in the Loyalty Program Terms. Sections of these Terms that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will survive.
10. Food, allergens, and product information
We strive to keep product information — including ingredients and allergen information — accurate, but it may change without notice. If you have severe allergies, please ask staff at the branch before ordering. Photographs are illustrative and actual products may differ slightly.
11. Disclaimers
Except as expressly stated, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We don’t warrant that the Services will be uninterrupted, error-free, or free from harmful components.
12. Limitation of liability
To the maximum extent permitted by Philippine law, Omnilert Food & Beverages will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services. Our total aggregate liability for any claim arising out of these Terms or the Services will not exceed the greater of (a) the amount you paid to us in the six months preceding the claim, or (b) one thousand pesos (PHP 1,000).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Omnilert Food & Beverages, its affiliates, officers, employees, and partners from any claims, losses, or expenses arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email to active account holders before they take effect, or by a notice on the Services. Continued use of the Services after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts of the Philippines.
16. Severability and waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision will not be considered a waiver of that right or provision.
